Shettima, Tinubu’s Running Partner, Had Been Requested To Be Arrested by Police

For the general election of 2023, the Center for Reform and Public Advocacy, a civil society organization, has petitioned the Inspector General of Police (IGP) to arrest and prosecute Senator Kashim Shettima, APC vice presidential candidate, for suspected duplicate nominations.

According to reports, Shettima was nominated twice by the APC for two distinct constituencies at the same time in violation of the Electoral Act 2022, to run for president alongside former Lagos State Governor Bola Ahmed Tinubu.

When Shettima allegedly signed two INEC forms on two different occasions as the APC’s candidate for Borno Central Senatorial District’s 2023 elections, the petition claims he did so under oath as well as as the party’s vice presidential candidate, a move that may have been illegal under Nigerian law.

Section 115(d) and (k) of the Electoral Act 2022 states that if Shetima signs two nomination forms for two distinct constituencies, she will be sentenced to two years in prison.

Non-governmental organizations, they stated in the petition, which was signed by the Legal Adviser of the group and received by the office of the IGP on July 29, were promoting good governance, accountability, probity and openness in public institutions.

They complained that Shettima, on oath and contrary to the provisions of the 2022 Electoral Act, engaged in double nominations and should be detained and placed on trial by the police.

That the All Progressives Congress, APC, submitted the name of Senator Kashim Shetima to the Independent National Electoral Commission, in accordance with Section 29 of the Electoral Act 2022, as its candidate for the Borno Central Senatorial District of Borno State for the 2023 general election,” read the petition obtained by a DAILY POST correspondent.

On his oath of office, Senator Kashim Shetima officially declared himself an APC contender for the Borno Central Senate District in the state’s general election of 2023.

APC candidate Kashim Shetima was named as the APC candidate for the Borno Central Senatorial District on June 24, 2022, by INEC, in accordance with Section 29 of the Electoral Act 2022.

Senator Kashim Shetima’s name was submitted to INEC on July 15, 2022, as the APC’s vice presidential candidate for the 2023 presidential election, following the aforementioned publication of Senator Kashim Shetima.

APC Vice-Presidential Candidate Kashim Shetima signed the INEC EC9 Form on oath, which is his nomination form for the 2023 presidential election.

If found guilty, the person who signs a nomination paper or result form for more than one constituency at the same election commits an offense and faces a maximum sentence of two years in prison. That section 115 (1) (d).

When someone signs an election nomination document knowing they are unqualified to run, they are breaking the law and might face up to two years in prison, according to section 115(1) (k) of the Criminal Code.

According to the Electoral Act 2022, Senator Kashim Shetima is in violation of section 115 (1) (d)(k) since he signed candidacy papers for two separate seats.

With the evidence outlined above, we respectfully request that Senator Kashim Shetima be arrested and criminally prosecuted for violating Section 115 (1) (d) (k) of the Electoral Act 2022.
